Website Terms of Use and Fair Usage Policy of XeniaHosting
By accessing the website xeniahosting.com (hereinafter the "Site") and using the services offered by XeniaHosting ("XeniaHosting", "we", "our"), the user ("Client") agrees to be bound by all legal documents published on the Site, including these terms, as well as all applicable laws and regulations, and declares to be responsible for compliance with any local laws in force.
If you do not agree with any of these terms, you are prohibited from using the Site and XeniaHosting services.
All content on the Site is protected by applicable copyright, trademark, and intellectual property laws. Any violation of these terms may result in the immediate termination of your account and the right to use our services, without any refund.
1. Purpose and Scope of the Fair Usage Policy
XeniaHosting primarily provides game server hosting, VPS, dedicated servers, and other infrastructure services.
This Fair Usage Policy governs the use of our network and computing resources, with the aim of:
- ensuring all customers receive a fair, stable, and reliable service;
- preventing abuse or anomalous use of shared resources;
- protecting the overall performance of our infrastructure.
This Policy applies to all XeniaHosting services, except where otherwise and expressly indicated in other contractual documents.
2. Fair Usage Policy for Bandwidth
Our network is designed to deliver high performance even in shared environments. For this reason, XeniaHosting:
- does not normally impose strict ("hard cap") bandwidth limits;
- monitors average resource usage on each node (physical server or shared infrastructure);
- intervenes when a single Client's usage causes or risks causing service degradation for other Clients or exceeds the traffic ranges indicated in this Fair Usage Policy.
If a Client's bandwidth consumption:
- exceeds the average of the node hosting the service; and/or
- exceeds the indicative traffic ranges associated with their plan, even slightly,
XeniaHosting, at its discretion, may adopt, by way of example and not exhaustively, the following interventions:
- sending a notice and request to optimize usage;
- applying temporary traffic limitations (shaping/throttling);
- proposing migration to a more suitable plan or solution;
- total or partial suspension of the affected service until the beginning of the next calendar month, in any case of exceeding fair use limits;
- temporary suspension or termination of the service in case of violations of the Terms of Service or other contractual documentation.
Suspension until the beginning of the next calendar month does not entitle to any refund for the suspension period, except as may be provided by mandatory legal provisions.
2.1 Indicative Monthly Traffic Values
To ensure transparency, we report below some indicative monthly traffic ranges, based on the type of service:
- Virtualized Services (VPS, Cloud, etc.): up to 10 TB of traffic per month (increasable with additional paid options).
- Dedicated Servers: up to 50 TB of traffic per month (increasable with additional paid options).
- Other plans or services where no limit is expressly specified: up to 5 TB of traffic per month.
These values:
- represent guidelines for ordinary service usage;
- are used by XeniaHosting to evaluate the Client's usage compliance with proper use of shared resources.
In case of exceeding the above ranges, even minimally (e.g., excesses of a few megabytes), XeniaHosting, having evaluated the overall network conditions and the potential impact on other Clients, will have the right to:
- request usage adjustment or activation of a higher plan;
- apply temporary bandwidth limitations;
- suspend the affected service until the beginning of the next calendar month, at its discretion.
3. Use of Computing and Storage Resources
In addition to bandwidth, XeniaHosting also reasonably monitors the use of:
- CPU;
- RAM;
- Disk I/O and storage space.
It is prohibited to:
- use resources in a way that stably saturates the shared node to the detriment of other Clients (e.g., processes constantly at 100% CPU on shared services or basic-tier VPS);
- circumvent the technical limits provided by the purchased plan;
- use services as a platform for massive and continuous file distribution unrelated to normal use of a hosting or game server service.
In case of anomalous or excessive use of computing or storage resources, XeniaHosting may adopt measures similar to those provided for bandwidth (warnings, limitations, plan migration, service suspension).
4. Network Usage Restrictions
4.1 Proxy, VPN and Tunneling
It is permitted to configure proxy, VPN, or other tunneling services on your XeniaHosting servers, provided that:
- usage is compliant with this Policy and the Terms of Service;
- no illegal, abusive traffic or traffic that violates third-party rights is carried out;
- prohibited activities are not masked (e.g., attacks, spam, massive scanning towards third parties).
In case of suspected abuse, XeniaHosting may suspend or limit such services.
4.2 Multimedia Streaming Services
Hosting multimedia streaming services on our network is only permitted after notice and technical evaluation by the XeniaHosting team.
This category includes, by way of example:
- continuous video streaming;
- music streaming;
- live streaming platforms / live broadcasting.
These services often generate intensive and continuous traffic that must be properly sized to avoid penalizing the shared infrastructure.
4.3 Speed Test Servers
The use of XeniaHosting network resources to host speed test servers (e.g., speedtest, bandwidth measurement tools) is only possible after authorization from our team.
In the absence of authorization, XeniaHosting may remove or limit such services if they cause anomalous traffic loads.
4.4 Automated Software, Abusive Activities and Anomalous Traffic
It is strictly prohibited to use XeniaHosting services for:
- running automated scripts, bots, or software that generate continuous or massive traffic not justified by normal service use (e.g., stress test tools, flood, DDoS, massive port scanning towards third parties);
- performing aggressive or massive unauthorized scraping activities;
- mining activities (cryptocurrencies or similar) if not expressly permitted by the plan and contract;
- distributing malware, participating in botnets, sending SPAM, or carrying out any illegal activity or activity that violates third-party rights.
Such activities may result in immediate suspension or permanent termination of the service, without notice and without right to refund, in addition to possible reporting to the competent authorities.
5. Policy Monitoring and Enforcement
XeniaHosting monitors network and system resource usage to:
- prevent abuse;
- ensure infrastructure stability and security;
- intervene in case of anomalies or violations of contractual terms or these fair use limits.
As a rule, in case of violation of this Policy, XeniaHosting:
- will contact the Client to inform them of the situation and request usage adjustment, except in cases of urgency or evident abuse;
- may apply temporary limitations (e.g., bandwidth, CPU, I/O limitations);
- may propose migration to a more suitable plan;
- in case of exceeding fair use limits, even minimal, or anomalous usage that impacts infrastructure or service quality, may suspend in whole or in part the affected service until the beginning of the next calendar month, without right to refund for the suspension period, subject to any mandatory legal provisions;
- in the most serious or urgent cases (attacks, illegal activities, risk to infrastructure), may proceed to immediate suspension or termination of the service even without notice, subject to the right to compensation for damages.
XeniaHosting prefers, where possible, collaborative management with the Client, but reserves the right to adopt any measure deemed necessary to protect its network, other Clients, and third parties.
5.1 Client Responsibility
The Client is fully responsible for all activities carried out through their services (account, server, VPS instances, etc.), even if performed by third parties to whom they have granted access.
Any abuse, malicious activity, or unauthorized use of XeniaHosting resources originating from services registered to the Client may result in:
- service suspension or termination;
- request for compensation for any direct and indirect damages caused to XeniaHosting or third parties;
- possible legal actions in competent venues.
It is the Client's responsibility to adopt adequate security measures, such as:
- keeping systems and software updated;
- using robust credentials;
- limiting unnecessary access;
- monitoring the use of their services by third parties.
6. Questions and Clarifications
In case of doubts about the interpretation of this Policy, or if you intend to activate a service that might involve intensive or peculiar resource usage (events, streaming, high-traffic projects), we invite you to contact our XeniaHosting support team before activation or modification of services.
Our goal is to find together the most suitable solution for your needs, while respecting the integrity and performance of our infrastructure.
7. Relationship with Terms of Service
This Fair Usage Policy constitutes an integral part of XeniaHosting's Terms of Service.
In case of any inconsistencies between this document and the Terms of Service, the Terms of Service shall prevail.
8. Policy Modification
XeniaHosting reserves the right to modify and update this Policy periodically to adapt it to:
- technological evolution;
- changed network and market conditions;
- customer needs;
- new regulatory or regulatory provisions.
In case of significant modifications, XeniaHosting will inform Clients through the Site or other channels deemed appropriate. Continued use of services after publication of modifications will constitute acceptance of the new conditions.
